I was injured on United Airlines Flight UA198 from Los Angeles, California to Shanghai, China.
During the final beverage service before landing, a flight attendant accidentally spilled an entire pot of very hot water onto my thigh. The burn was severe enough that the crew immediately provided first aid, documented the incident, and I also took photos of both the accident scene and the injury.
I am seeking medical treatment today and will keep all medical records and expenses.
I have several legal questions:
-
Does this type of injury on an international flight fall under the Montreal Convention, California law, federal law, or a combination of these?
-
Should I report the claim directly to United Airlines first, or should I consult a personal injury attorney before communicating with their claims department?
-
If United is legally responsible, what types of compensation are typically available besides reimbursement of medical expenses (such as pain and suffering, permanent scarring, lost income, or other damages)?
-
Are there any important deadlines or steps I should take now to preserve my legal rights and evidence?
I appreciate any legal guidance on the best way to proceed.
